European Court of Human Rights Issues Decision in Miketić v. Montenegro – Application Struck Out of the List of Cases

The European Court of Human Rights issued a decision in Miketić v. Montenegro (application no. 19955/24), in which the applicant complained about the excessive length of the constitutional proceedings, concluding that the application should be struck out of the list of cases. Article 37 § 1 (a) of the Convention provides that the European Court may strike an application out of its list of cases when the circumstances lead to the conclusion that the applicant does not intend to pursue the application. Since the applicant did not submit a response to the observations, the European Court concluded that the applicant did not wish to pursue the proceedings concerning the application. As there were no special circumstances relating to respect for the human rights guaranteed by the Convention and its Protocols that would require continued examination of the application, the European Court decided to strike the case out of its list of cases. The decision is available in English on the website of the EUROPEAN COURT.
