European Court of Human Rights issued rulings in the cases of ŠAJO DOO and Dejan Đurović and others against Montenegro
In 2023, the European Court of Human Rights issued rulings in the cases of ŠAJO DOO against Montenegro (application no. 8610/25) and Dejan Đurović and others against Montenegro (application no. 10418/25), finding a violation of Article 6(1) of the European Convention on Human Rights due to excessive length of proceedings before the Constitutional Court of Montenegro in both cases (3 years, 11 months, and 18 days; 4 years, 3 months, and 23 days). The Office of the Montenegrin representative before the European Court notes that the cases concern the excessive duration of proceedings before the Constitutional Court of Montenegro during a period when the court, due to an incomplete composition, was unable to perform its duties normally, causing delays in deciding constitutional appeals. The relevant decision is available on the European Court's website in English.
