EDPB clarifies data processing for scientific research, accelerates finalization of anonymization guidelines, and approves the first European data protection seal
The EDPB also adopted two opinions on two sets of criteria for issuing Europrivacy certificates to be approved as European data protection seals, one of which is to be used as a data transfer tool. The rise of new technologies, such as artificial intelligence, also contributes to scientific progress by enabling researchers to utilize and analyze data in innovative ways. The EDPB is committed to supporting the scientific community and unlocking the full potential of scientific research in the EU while respecting data protection rights. In its guidelines, the EDPB clarifies the concept of "scientific research". To determine whether processing is for scientific research purposes under the GDPR, the EDPB provides six key guiding factors to be considered alongside the nature, scope, context, and purposes of processing. Additionally, the EDPB has for the first time adopted an opinion recognizing the criteria for issuing Europrivacy certificates as European data protection seals, which are to be used as data transfer tools in accordance with Articles 42 and 46 of the GDPR. The seal must meet specific criteria approved by the EDPB and be issued by an accreditation body authorized under Article 43 of the GDPR to demonstrate compliance with its standards.
